واکاوی حقوقی حمایت از حریم خصوصی کودک در فضای مجازی با نگاهی به قوانین ایران و معاهدات بین المللی

چکیده

توجه به حقوق کودکان به عنوان یکی از بنیادی‌ترین حقوق بشر، در تامین سعادت جامعه و هدایت سیاست‌گذاری‌ کلان کشورها، تحکیم و حفظ نهاد خانواده نقش موثری ایفا می‌کند. حمایت قانون از حقوق کودکان در فضای مجازی نیز تابع این قاعده است. حمایت از کودکان در فضای مجازی مستلزم اقدامات تقنینی در جرم‌انگاری رفتارهای بزهکارانه با استفاده از فناوری‌های اطلاعات و ارتباطات و یا جبران خسارات جسمی و روحی وارده به کودک و لطمات روحی به وی به واسطه هتک حیثیت عرفی کودک از این طریق است.
این نوشتار ضمن بررسی قوانین و مقررات موجود کشور بویژه قانون حمایت از اطفال و نوجوانان که اخیرا در مجلس شورای اسلامی به تصویب رسیده و با نگاهی به کنوانسیون‌ها، معاهدات و قطعنامه و پروتکل‌های بین‌المللی درخصوص حمایت قانونی از حریم خصوصی کودک در فضای مجازی، به نحوه مقابله قانونی با نقض این حقوق و درج شرایط و مفاد لازم جهت حمایت از اطفال در فضای مجازی در نظام تقنینی ایران می‌پردازد.

این نوشتار ضمن بررسی قوانین و مقررات موجود کشور بویژه قانون حمایت از اطفال و نوجوانان که اخیرا در مجلس شورای اسلامی به تصویب رسیده و با نگاهی به کنوانسیون‌ها، معاهدات و قطعنامه و پروتکل‌های بین‌المللی درخصوص حمایت قانونی از حریم خصوصی کودک در فضای مجازی، به نحوه مقابله قانونی با نقض این حقوق و درج شرایط و مفاد لازم جهت حمایت از اطفال در فضای مجازی در نظام تقنینی ایران می‌پردازد.

چکیده [English]

Since children’s rights, as one of the most foundamental human rights, play effective role in securing the prosperity of the society, leading the overall policymaking of the countries, strengthening and maintain of the family entity. This is why the law protects the children rights in the cyberspace. Protection of children rights in the cyberspace inquires for the legislative measures to be taken in order to criminalize the offensive conducts aginst the children via IT technologies as well to compensate the phycial and mental damages may be inflicted on the children and spiritual impacts on the child due to the disrepct of the child personality in this venue.
This paper, while investigating the existing rules and regulations of the Country, particularly on the legal protection of the children and teenagers that has been recently legislated by the Islamic Council Assembly of Iran and with the overview on the conventions, treaties, international resolution and protocoless that deal with the legal protection of the children privacy in the cyberspace, investigates the legal measures in comabting with the violations of the children rights and determines under what terms and conditions such measures could be taken under Iranian legislation
