چکیده

ازدواج عرفی که در عصر حاضر در میان برخی از مردم کشورهای سنی مذهب؛ بویژه گردشگران عرب کشورهای حوزه خلیج‌فارس مرسوم شده، نکاحی است که خارج از دادگاه و بدون نظارت آن انجام می‌گیرد، و غالباً بدون حضور ولی و محرمانه رخ می‌دهد. در صحت و بطلان آن میان مفتیان اهل تسنن اختلاف نظر وجود دارد. با توجه به شباهت‌ها و تفاوت‌هایی که با ازدواج دائم و نیز موقت دارد، بررسی ماهیت و مشروعیت آن در میان دانشیان اهل سنت، تبیین انگیزهای روی‌آوری به آن و تعیین وضعیت آن در حیطه قیود و شرایطی که ازدواج شرعی در دین اسلام دارد، از اهمیت و ضرورت بسزایی برخوردار است. در این پژوهش که به روش توصیفی تحلیلی انجام پذیرفته، ضمن برشمردن مهم‌ترین عوامل گرایش به این نوع ازدواج، به دست آمده است که ازدواج مذکور به دلیل دارا نبودن برخی ارکان و شرایط ازدواج دائم؛ از قبیل مهریه، تهیه مسکن و نفقه، و نیز برخی از ارکان ازدواج موقت؛ مثل تعیین مدت نکاح، مشروعیت ندارد و گرایش بخشی از جوامع سنی مذهب به آن، اذعان به صحت اعتقاد شیعه به مشروعیت ازدواج موقت می‌باشد.

چکیده [English]

Urfi (Customary) marriage, which was first propagated in Yemen as Thursday marriage, has been spread among Sunnite Arabs of PersianGulf countries who used to go to the lush country of Yemen to spend their holidays in summer. The appellation of the term 'urfi (customary) marriage goes back to the belief that from the time of Prophet Muhammad (PBUH) onwards, it was practiced by Muslims.
This type of marriage takes place out of court and unsupervised by it, and often occurs confidentially and without parental supervision. There is disagreement among Sunnite Muftis about the validity or invalidity of 'urfi (customary) marriage. Due to the position, constraints and conditions of marriage in Islam, and also because of the existing ambiguities about the validity of 'urfi (customary) marriage, it seems that recognition, explanation and studying the nature and evidences of its advocates and opponents is of high importance and necessity. This research is based on a descriptiveanalytical
method in which the illegitimacy and invalidity of 'urfi (customary) marriage has been proven and some of its consequences and challenges have been mentioned.
